Introduction
Intentional Machines Co. d/b/a bluekorner (the "Company" or "We") respects your privacy and is committed to protecting it through our compliance with this privacy policy.
This policy describes the types of information we may collect from you or that you may provide when you (a) use the bluekorner mobile application (the “Application”) and any related interactive and informational services and products made available to users (“Services”), (b) sign-up to be a customer, (c) create a dashboard for your business (the “Dashboard”) or (d) visit the website www. bluekorner.com (the "Website") and our practices for collecting, using, maintaining, protecting and disclosing that information.
This policy does not apply to information collected by (a) us offline or through any other means, including on any other website operated by the Company or any third party; or (b) any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Application, the Services or the Website.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Application, any of the Services, the Dashboard or the Website. By accessing or using the Application, any of the Services, the Dashboard or the Website, you agree to this privacy policy. This policy may change from time to time. Your continued use of the Application, any of the Services, the Dashboard or the Website after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.
What Information Do We Collect?
Personal Information That You Provide: We receive and store any information that you provide to us, either directly or through your use of the Application, any of our Services, the Dashboard or the Website. For example, we collect personally identifiable information (“Personal Information”) from you when you complete your “Profile” for the Application or the Dashboard or log into the Application through Facebook (or other similar site) or contact us with inquiries.
You may also provide information through the publication or display (hereinafter, "posted") on public areas of the Application, or transmitted to other users of the Application (e.g., through a chat function, etc.)(collectively, "User Contributions").
Information that is Not Personal Information: We may collect information about you but individually does not identify you, such as IP address, date and time of visits, sites that are bookmarked and locations that are identified by you as important.
Location and Beacon Information: We may collect two kinds of location information through your use of the Application or the Services on your mobile device. We may gather location information through your mobile device’s geolocation, GPS, or similar capabilities. We also collect information about your location through your mobile device’s BLE Beacon or similar capabilities in combination with technology implemented by and with our partners. To do this, we may also use the signal of our “beacon” presence technology devices (or another geolocation or presence technology) which are located in various locations, for example, in a store or restaurant. Those devices broadcast signals that can be received by a mobile device on which the Application is installed. When the phone receives the beacon signal, if consent has been provided to receive push notifications or messages from the Application (please see our Terms of Service), we may send a message or an image through the Application, for example, about available discounts, deals or other information. We refer to the location information collected through your mobile device’s applicable GPS, BLE Beacon or similar capabilities simply as “Location Information.” To make the Application and Services operate better, we may also collect other information based on the beacon signals, for example, the strength of the signal between the beacon and the mobile device, the duration the mobile device is near the beacon, or the battery level of the beacon itself, including when the Application is in the background or not running. Once you have installed the Application, the Application will continue to collect Location Information until you use your phone’s or other device’s setting to disable your mobile device’s applicable geolocation, GPS, BLE Beacon or similar capabilities for the Application or Services or uninstall the Application from your mobile device.
Financial and Billing Information: If you are a customer of the Company, we may collect financial and billing information in connection with the payment of subscription and other fees and expenses.
Information Collected Automatically: When you use the Application or the Website or utilize the Services, we may automatically collect certain information about your use of the Application or the Services, such as the business that you linked to or visited (“Information Collected Automatically”).
Technical Information: We may collection information about your internet connection, the mobile device and other equipment and operating systems you use to access the Application, the Services, the Dashboard and the Website.
Aggregated Personal Information: In an ongoing effort to better understand our users and customers, we may aggregate and compile Personal Information and other information we collect from our users and customers in a way that does not personally identify any one user (“Aggregated Personal Information”).
How Do We Use And Disclose This Information?
Personal Information: The Personal Information we collect is used for such purposes as enhancing our Service’s functionality or features, responding to your requests and communications, providing you with information about specials, restaurants, stores and other businesses, and to otherwise operate our business. We may also share certain information, such as Location Information and Information Collected Automatically, with our business partners so that they may better serve you with offers or otherwise.
Location Information: We treat and use Location Information as Personal Information.
Information Collected Automatically: We may use such information individually as Personal Information or we may pool it with other information to track, for example, the total number of visitors to the Services, the number of visitors to each page of the Services, and the domain names of our visitors’ Internet service providers. To the extent that this information is Personal Information, we treat it as such.
We may also use your information for direct and indirect marketing and on-line behavioral advertising regarding our own and third party products and services.
Aggregated Personal Information: We may use aggregated information to conduct research on our end users’ demographics, interests and behaviors or to otherwise operate or improve our business and we may share this information with our affiliates, agents, business partners and other third parties, including our retail partners. As an example, we may provide to our customers information about when users visit their businesses most frequently and which places are viewed most frequently. We may also disclose aggregated user statistics to describe our Services to current and prospective customers, business partners and to other third parties for other lawful purposes.
How Else Do We Disclose Information?
In addition to the foregoing, there are certain other circumstances in which we may share your information with certain third parties without further notice to you, including as set forth below:
Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a sale, merger, reorganization, dissolution or similar event relating to all or a portion of our business, assets, the Application, the Services, the Dashboard and the Website, Personal Information or other information may be shared during the process or as part of the transferred assets.
Service Providers, Agents and Related Third Parties: We may use or partner with other third party companies, agents or contractors for various purposes in connection with our business and operations (“Service Providers”), including , relationship building, the marketing and growth of our business and the performance of services on our behalf, such as gathering and analyzing information and the provision of services to you. In the course of performing these responsibilities and providing such services, these other companies may have access to your information. We may also share information, including your information, with these Services Providers in order to enable them to perform these responsibilities and to provide these services. Many Services Providers have adopted their own privacy policies, which are not subject to control by the Company.
Legal Requirements: We may also disclose your information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend our rights or property, (iii) act in urgent circumstances to protect the personal safety of users of the Application, the Services, the Dashboard, the Website or the public, or (iv) protect against legal liability.
How Do We Store And Transfer Information?
We understand that the security of your Personal Information is important. We may store any information that we collect (personal or otherwise) ourselves or in databases owned and maintained by our affiliates, agents or service providers. In doing so, we may transfer this information from your current location to our offices and servers or those of our affiliates or contractors located in the United States and other countries. By using the Services, you consent to such transfer. This privacy policy and its protections still apply to such information.
We provide reasonable administrative, technical, and physical security controls to protect your Personal Information. However, despite our efforts, no security controls are 100% effective and the Company cannot ensure or warrant the security of your Personal Information. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Application or the Website, including any loss caused due to any data breach or hacking, even if it is our mistake..
Your User Contributions are posted on and transmitted to others at your own risk. We cannot control the actions of other users of Application or the Website with whom your User Contributions are shared. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
How Do We Communicate With You?
We may communicate with you through email, if you have provided it to us, and notices posted on the Application and the Website.
What Choices Can I Make About My Information?
You can use the Application and the Services without providing any Personal Information. You can also restrict the Personal Information we collect by doing such things as uninstalling the Application or turning off or preventing the Application from using your mobile device’s geolocation, BLE Beacon, or similar capabilities. However, taking these actions may prevent you from using certain features or aspects of the Services.
Links To Other Websites
The Application, the Services and the Website may contain references, links or interactions with other websites not operated or controlled by us (“Third Party Sites”). The policies and procedures we describe here do not apply to Third Party Sites, and these sites may independently collect information about you. bluekorner assumes no responsibility or liability for the privacy and information collection policies of these third parties and we suggest contacting the providers of those sites directly for information on their privacy policies.
Children Under the Age of 13
None of the Application, the Services, the Dashboard or the Website is intended for children under 13 years of age. No one under age 13 may provide any information to or on the Application, the Dashboard or the Website or on or through any of the Services. We do not knowingly collect personal information from children under 13. If you are under 13, do not use the Application, any of the Services or Website or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. Notice To California Residents
If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by Swirl to third parties for the third parties’ direct marketing purposes. Changes To Our Privacy Policy
We reserve the right to update or modify this privacy policy at any time and from time to time without prior notice. Please review this policy periodically, and especially before you provide any Personal Information. If we make material changes to how we treat your Personal Information that are materially less protective than provided in this policy, we will use reasonable efforts to notify you by e-mail to the e-mail address specified in your profile and/or through a notice on the home pages of the Application and the Website and to attempt to get your consent to the changes. The date the privacy policy was last updated is identified at the top of this policy. You are responsible for ensuring that we have an up-to-date active and deliverable e-mail address for you, and for periodically visiting the this privacy policy to check for any changes. Like our Terms of Service, of which this policy is a part, your use of the Application, the Dashboard or the Website, and/or continued use of any of the Services after our efforts to contact you means that you agree to be bound by such changes.
